Terms of Service

1. Acceptance of Terms

By accessing or using letboomspeak.com, videos.letboomspeak.com, or any associated services (collectively, “the Service”), you agree to be bound by these Terms of Service. Your continued use of the Service constitutes your legal agreement to these terms. If you do not agree to these terms, you must cease all use of the Service immediately and immediately request removal of any accounts owned by you, if applicable.

2. Description of Service

LetBoomSpeak is a multimedia platform dedicated to providing community-driven content and video hosting services. Our services include:

News & Information

A dedicated news portal offering updates, analysis, and reporting on the “Skibidi Toilet” online series, “Invisible Narratives, LLC,” and other relevant industry developments.

Video Hosting Platform

A specialized video-sharing environment (“LetBoomSpeak Videos”) designed to provide creators with an alternative, secure space to host and share their content.

Historical Timelines

An interactive timeline service documenting significant events related to the “Skibidi Toilet” universe and its associated entities.

3. User Registration

3.1 Account Creation

To access specific features of the LetBoomSpeak platform, you are required to register for an account. By creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for securing access to your account.

3.2 User Responsibilities and Eligibility

  • Age Requirement: You must be at least 13 years of age to access or use the Service. By registering, you represent and warrant that you meet this minimum age requirement.
  • Account Activity: You are legally responsible for all activities, uploads, and interactions that occur under your account.
  • Security Notification: You must notify LetBoomSpeak immediately at [email protected] regarding any unauthorized use of your account or any other suspected breach of security.
  • Information Accuracy: Failure to maintain accurate account information may result in the suspension or termination of your access to the platform.

4. Video Submissions

LetBoomSpeak offers a video hosting service (“LetBoomSpeak Videos”) accessible at videos.letboomspeak.com. By uploading content to this platform, you agree to the following technical and community standards:

4.1.1 Technical Specifications

  • File Format: To ensure cross-platform compatibility and playback consistency, all uploads must be in .mp4 format.
  • File Size Limits: To maintain platform performance and ensure equitable resource distribution, videos are limited to a maximum size of 5GB per file.
  • File Integrity: You are responsible for ensuring that uploaded files are not corrupted. LetBoomSpeak reserves the right to remove videos that are unplayable or improperly encoded without prior notice.

4.1.2 Copyrighted Content

  • Prohibition of Infringing Material: You may not upload, post, or otherwise transmit any video content that contains material protected by copyright, trademark, or other intellectual property rights unless you own those rights or have received all necessary consents from the rightful owners.
  • Enforcement and Penalties: We respect the intellectual property of others and reserve the right, at our sole discretion, to remove any content that appears to violate copyright law. Repeated or blatant infringements will result in the immediate suspension or permanent termination of the associated account.
  • Fair Use Exception: We recognize the doctrine of “Fair Use” as defined under Section 107 of the U.S. Copyright Act. Content used for purposes such as criticism, comment, news reporting, teaching, scholarship, or research may be permitted to remain online. However, the determination of Fair Use is fact-specific; for further guidance, please consult the U.S. Copyright Office Fair Use Index.

4.1.3 Copyright Infringement Claims (DMCA Notice)

Reporting Infringement: If you are a copyright owner or an authorized agent and believe that any content hosted on LetBoomSpeak Videos infringes upon your copyrights, you may submit a formal notification to our email [email protected]. To ensure a timely response, please ensure that you have followed the format to submit a claim on https://letboomspeak.com/about/terms-of-service/copyright-claims/ if you do not adhere to the format, responses may be delayed, or not received at all. Our moderation team will carefully review the data and will determine if the request is valid or not. If determined to be valid, the creator will have 7 business days to remove the video in question. During this time they can also appeal this decision. If they do choose to appeal, an email will be sent back to the claimant that they have appealed, and their reasoning for appeal. The claimant will have 48 hours to respond to the claim, and give detailed justification and reasoning on why the video is copyright claimed. Otherwise, the claim will be deemed invalid, and the video will remain online. If the detailed justification from the claimant appears to be valid, the video will be removed. Please note, you may only make ONE (1) claim per video at a time. We are a small team and cannot handle a large volume of requests, especially multiple requests for the same video.

4.1.4 Explicit Content

  • Users are strictly prohibited from uploading, posting, or sharing any videos that contain explicit sexual content, nudity, pornography, or graphic violence, collectively referred to as ‘NSFW Content’.
  • NSFW Content includes, but is not limited to: real or simulated sexual acts, pornographic material, full or partial nudity, sexual violence, non-consensual sexual content, and gratuitous, graphic violence or gore.
  • We reserve the right, at our sole discretion, to determine what constitutes NSFW content and to immediately remove any such content without prior notice.
  • Violation of this policy may result in immediate suspension or permanent termination of your account, and we may report such activity to law enforcement agencies,
  • You represent and warrant that you own or have the necessary licenses to share your content and that it complies with all safety guidelines.

4.1.5 System Integrity and Abuse

  • Prohibition of Abuse: You may not use LetBoomSpeak Videos in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the platform. This includes, but is not limited to, actions that place an undue burden on our infrastructure, such as automated scraping, denial-of-service attacks, or the intentional distribution of malware.
  • Enforcement: We reserve the right, at our sole discretion, to monitor usage patterns and determine what constitutes an abuse of the system. If a user is found to be compromising the stability or performance of the platform, LetBoomSpeak reserves the right to immediately remove offending content, restrict system access, or permanently terminate the associated account.

4.2 Content Management and Creator Standards

Users approved for a LetBoomSpeak Videos Creator Account are granted access to a Creator Dashboard. This dashboard allows for the management of channel metadata and uploaded content. All creators must adhere to the following standards:

4.2.1 Metadata and Compliance

  • Content Standards: All video thumbnails, titles, and descriptions are subject to the same System Integrity and Abuse standards outlined in Section 4.1.4. Metadata must not be used to mislead users, distribute malicious links, or circumvent platform security.
  • Thumbnail Specifications: To maintain site performance and visual consistency, thumbnails must be in .jpg or .png format and may not exceed a maximum file size of 2MB.

4.2.2 Right of Modification

LetBoomSpeak reserves the right to remove or edit metadata that violates these terms or is deemed inappropriate for the platform’s community standards.

5. Prohibited Content

You agree not to:

  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal purposes
  • Harass, abuse, or harm other users
  • Scrape or collect user data without permission
  • Circumvent any access controls or rate limits
  • Upload content that infringes intellectual property rights (see Section 4.1.3 for more information).

6. Intellectual Property

The LetBoomSpeak website, branding, and original content are owned by LetBoomSpeak.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETBOOMSPEAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless LetBoomSpeak from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason at our discretion.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by applicable laws. Any disputes shall be resolved through appropriate legal channels
